SPECIAL PROVISIONS:

    1. If said Entertainment is unable to perform as required by this agreement because of Acts of God, accident, illness, or other causes beyond the control of the SOLAR WINDS of Houston, we shall not be considered to be in breach of contract, and we may substitute talent, subject to the reasonable approval of the Purchaser, failing which approval this agreement shall terminate without obligation to either party, except that any deposit shall be returned to Purchaser.

    2. The SOLAR WINDS of Houston are independent contractors and are not employees of the Purchaser.

BOTH PARTIES ACKNOWLEDGE AND CONFIRM THAT WE HAVE READ AND APPROVE THE TERMS AND CONDITIONS SET FORTH IN THIS CONTRACT.
